Bannatynes Contract

Hi,
I know there are a lot of posts about gym membership and Bannatynes but i do have a problem that is different from all the other posts,
I joined my local bannatynes in July 2009 and got August as my free Month, I paid one month in advance (September) and should have started paying each month from October. I checked to see if the DD instruction was set up on my account and it was.
All was well until last week (friday 11th June 2010) when i was denied entry and was told by the staff i had not paid anything to date, I checked my bank and sure enough they had taken no money from October last year leaving me owing £432, (9 months @ £48) The manager has admited fault and they have only found the error after been audited last week, I joined the gym to pay each month so that i didnt get a huge bill like this! I cant really afford to pay out £432 out and really dont know what to do.
Any advice would be appreciated

Did you even read what you typed?
You have not paid anything. Therefore, the money that should have been taken each month (£48) will STILL BE THERE. Nobody has taken this money. You did not pay it. It's still in your bank. Understand?
So, you should have paid £48 every month for 9 months. You actually paid zero. Therefore, every month, you have £48 extra in your bank than what you should have.
£48/month x 9 months = £432 should be in your bank account that HASN'T BEEN TAKEN. This amount conveniently adds up to the amount that you owe them. Co-incidence? I think not.
TLDR: Take the £432 that you should have (but didn't) pay and use that to clear the balance.0 -
I think the OP may have inadvertantly spent the money form his account.
I would suggest asking the gym, seen as how it was thier error, to possibly charge you 150% of the membership fee each month untill the debt is cleared, and have you in a contract stating as such. So rather than paying £48 per month, you pay £72, and £24 of that is clearing your debt.0 -
