phone charger not part of deal?

Hi, I bought my daughter a phone for Christmas from Carphone warehouse. However, the charger has topped charging the phone. She took it back to try and excahnge it but they say phone charger aren't included int he guarantee. Is this correct? Cos it won't work anyway without the correct charger! :eek:

    They are talking rubbish. If they won't go with the guarantee, then you can fall back on the Sale of Goods Act. The charger is not of 'merchantable quality' - ie it is not fit for purpose.

    If you had only bought the charger would they say the same thing ?

    Chargers are classed as an accessory and not covered by manufacturers warranty. CPW will exchange within 6 months though, so depending on when you bought it before Christmas you may be in luck.

    That is absolute bunkum! Accessory or not, they should work!
    Even if it was true, as said above you can use the "Sale of Goods Act. The charger is not of 'merchantable quality' - ie it is not fit for purpose."

    thanks for your replies, after reading them phoned c/phone warehouse phone number and after 10 mins (for consultation!) they came back to me and said should be able to have anew one under daughter's warrenty. So took it back to shop and asked for exchange. They weren't very keen but after I told them to phone the lady I'd spoke to they agreed to replace. It's just a shame they didn't do it in the first place when my daughter went in...then she wouldn't have had her confidence dented and I wouldn't have had to waste MY time and petrol making a second trip! Grrrrr!

    (2) If the buyer requires the seller to repair or replace the goods, the seller must—

    (a) repair or, as the case may be, replace the goods within a reasonable time but without causing significant inconvenience to the buyer;

    (b) bear any necessary costs incurred in doing so (including in particular the cost of any labour, materials or postage).

    Not really, the poster never claimed them to be exempt from SOGA, just the manufacturers warranty which is perfectly reasonable, legal and common.

    Yes really ! - "manufacturers warranty" was not the point in question here; neither was SoGA mentioned by the OP, myself, or "gleeful" - the question was about the retailers guarantee.
