Notice of Prosecution but won't be here!
Hi guys,
I've got a friend at work who has had a NIP through the post asking him to confirm that he was driving a vehicle that was caught speeding. Now he is planning on sending this off straightaway but it says he may not receive a reply for 28 days. Problem is next week he is emigrating to New Zealand!
What is the procedure of getting points etc added to his licence if he is away for an indefinate period such as this??
Any help is greatly appreciated.

If he doesn't complete the NIP he will be prosecuted. As he will not be around to defend the summons he will be found guilty in his absence and be fined and points placed on his UK licence.
If he does complete it and leaves the country, he will be likewise found guilty in his absence of the offence.
He should complete the NIP but make it clear on it that he is leaving the country and give the date. If it was me, I would post the notice back the day I leave or the day before if more convenient.
There is not much more he can do than that. The only difficulty could be that on failing to pay the fines and the court bailiff not being able to find him when he fails to attend court for non payment, they may issue a warrant for his arrest which will remain open and he would run the risk of being arrested anytime he came back to the UK.
What is happening to his post once he goes? If someone is going to collect it for him, they could notify the court from which the summons originates that he has emigrated.0 -
If there is a phone number on the notice of prosecution then I would try to ring it and explain the situation. However failing that I would fill the form in and attach or write on a note saying that he/she is emigrating next week - give the date. I doubt that they will just let it go though!
