Barclaycard full and final offers don't exist!

    I managed to get a 40% agreement from Barclaycard and Virgin (MBNA) credit card. However, my story took an entirely unexpected twist. Three months have gone by, and they are still sending me monthly statements, showing the £2700 payment, but also now reverting back to full interest and demanding the full monthly instalment.     I have the agreement in black and white, on paper. I have now received three monthly statements, each with charges, demanding immediate repayment of the full monthly due amount, with the charges and full interest.

    I wrote to the "customer relations department" some three weeks ago, yet all I got back was a generic letter stating I would receive a reply within eight weeks (they treated my letter as a formal complaint, evidently). No resolution yet.

    I really do not understand what is going on here. We agreed a sum; it was paid on time; I thought that would be the last of the matter. Yet it continues, unabated.

    Has anyone else experienced this!?

    Things are going from bad to worse with this..

    It's 5 weeks since my "official complaint" was sent; no reply. That's 5 or 6 letters over the past 2 months; none replied to as yet.

    Instead, I have received a letter, stating that a review has been carried out on my account and, because I have "been able to pay off a significant sum", it will revert to interest-bearing.

    This is almost surreal.

    In my latest letter, I told them that their letter agreeing to the full and final settlement is where I consider myself to stand legally, in terms of my debt to them, and no further payments would be made.

    It's now four months or so since I paid the agreed sum. Not only have I continued to receive monthly statements with payment requests; I have now been told I must continue to pay and pay interest.

    Surely this cannot be legal or enforceable??
  • What letter did you send to them? and what was the wording of what they sent back.

    If they says they will not pursue you and so on then they've breached the terms.
    £29,500+ of debt cleared Jul 2010 >> Dec 2011.....
    Now facing same again with £65,000 :mad:

    It's almost funny..

    The calls from Mercers have started up again over the last few days; when I call them back, they say they have "no knowledge" of my account status and/or F&F agreement.. Then they put me through to an Indian call centre, where the staff apologise and say it's all going to be rectified.

    If this continues more than another week, I will send a Letter Before Action, and sue them for harassment.

    And then... finally.. a formal letter acknowledging my payment, apologising for the harassment.., plus a caveat- "you should have called us once the telephone calls started"... (!!). This despite 10-25 calls a day from Barclaycard/Mercers etc/ with "no knowledge" of the settlement offer.. Jesus - I will never go near these people again in my life.. Funny, just what a "Letter Before Action" to the Legal & Compliance Department does -- that's the only reason this was sorted -- so hopefully good advice to others...
