    it's my understanding that banks can't take benefits money as settlement of debt - I think this is only a guideline however so it may depend on how much you have !!!!!! them off
    Debts at LBM (May '08) £5760 - Lloyds CC £4260, Lloyds OD £1500;
    Debts as of May 28th 2011:
    Santander CC: £0.00
    Lloyds OD : £0.00

    is there any way of finding out if they can LEGALLY take the money if it leaves you even worse off financially than you already are ?

    and yeah they will be really !!!!!! off because i claimed £800 off them in unfair charges 2 years ago & this all stems back from there ( more charges added once they settled my 1st claim ).

    Open a new "basic" account with no overdraft and no charges. Pay your benefits into that account and use it to pay off your others debts when you can afford to. Ask them to freeze the old account if it's still accruing interest

    What is the difference between JSA and any other credit?
    If you have spent money that is not yours expect to have to pay for it - whichever bank you are with.

    You could open a Post Office account for your benefits .
