Other driver drove off

Hi everyone,
Just need some advice about a recent accident that my brother had.
He was hit by a driver a few nights ago, they tried to overtake him before a roundabout, not seeing another car coming round the roundabout. When they did see it, they tried to pull in and hit my brothers car sending him in to the crash barrier and then in to a ditch. The driver of the other vehicle didn't stop.
He has a witness, as the person coming round the roundabout stopped to see if he was okay and gave him their phone number so she could help with his claim. The police have contacted her and she has confirmed what happened.
He is insured with swiftcover and has 2 years no claims. Basically they have said he will have to pay the excess on his policy (his car was old and is now a write off, so he is going to end up with a tiny amount of money), which as I understand is normal policy.
The thing I'm not sure about is that they are saying because the other driver didn't stop and he has had to claim from his own insurance, he will lose his two years no claims! Is this normal procedure. Also, they are saying that his claim will go down as an 'at fault' claim because the other driver didn't stop???
It just seems very unfair, that he will be so out of pocket and have to start from scratch again building up his no claims because of someone else's recklessness.:(

They have.
You only keep your NCD if the insurer gets fully reimbursed their costs from the third party.
(Worth looking at the cost - excess + loss of the equivalent of 3 years NCD (he won't get any added at the end of the current policy year) - to see if it is cost effective to claim off insurance, or just cancel the claim and pay for the repairs and retain the NCD)0 -

I'll get him to look at the costs and see if it's worth cancelling his claim. I think he was only due to get around £250 back from them.
It just seems so unfair that some people do things by the book, like getting insurance, while others (I'm imagining they didn't have insurance, driving license or something) just do whatever they like and get away with it! I presume that she didn't have the registration number of the car?
I understand your frustration but would you want to put someone else in this position?but it some times makes you wonder why you bother!!

I understand the frustration when other people apparently get away with things, but it clearly doesn't justify the same action i.e. two wrongs don't make a right.
It is possible that the other driver was in shock and possibly feared being beaten up by the other driver and may now be too scared to come forward.
I'm notsaying that makes it right, but just that there are lots of explanations beyond not caring.
Although fully appreciate it's difficult to be charitable when you are at a loss.0 -
Hi Lisyloo, no, unfortunately she didn't get the registration.
Like I said, I would never do anything illegal, I would never want to put someone else in this position (btw it was my brother). And I agree that two wrongs definitely don't make a right! But I still don't agree with the other driver driving off though, scared or not, it's your duty to stop after an accident!

I asked him about canceling his claim, but because he damaged the crash barrier a claim has been put in to swiftcover to pay for the costs, they have said it could be up to £2000:eek:The greatness of a nation and its moral progress can be judged by the way its animals are treated.0 -
