  • Agency A put the OP forward for one position. Agency B put the OP forward for a different position altogether. Had both put the OP forward for the same position then fine, but that wasn't the case here.

    This is all a bit mute point as it comes down to what is in the contract between Employer and agency A.

    But I would be very surprised if the contract didn't state for any position.

    Otherwise why not reject the applicant, change the job title, give job, pay no fee.


    I'm not saying I agree or disagree with this, but if that is in the contract, the employer signed it, tough.

    Your point is irrelevant.

    All that matters is the contract between agency & employer.

    I can tell you now, as a fact, that if terms had been agreed the employer would of agreed to pay a fee if the candidate is employed in any capacity or via a 3rd party.


    It is a business deal. It has nothing to do with the candidate & the employer is only trying to back out of paying money or doesn't think the candidate is worth it.


    Business is business & it will all be there in black & white. Unless the agency have rubbish terms or didn't get agreement on them.
