Your biggest problem is the fact that you are going to be homeless very soon. I think any mortgage relief (if applicable) is going to kick in too late to save your home. Contact Shelter asap as you are going to need some form of housing, this is likely to take the form of private renting. If both you and your OH are unemployed then you will be entitled to LHA and CTB - whether your OH will get JSA depends on his NI contributions. You may or may not both be entitled to income based JSA. Have you got any children? Obviously you don't have savings, or another property?

    hi thanx for your responce.

we have a 7 year old daughter.
as for NI we have both worked all our adult lives.
yes, NO savings, but lots of other debts, (near to BR), poss very little equity in the house.
we looked into the mortgage relife scheme, but the rent will be higher than our mortgage payments.
what would happen if we went that way and my oh's contract didn't get renewed??????
as the court date is next month, is it to late to go the relife way???

sorry for all the questions, but i cant think anymore.

You need to be on a qualifying benefit for 3 months before you get any help with the mortgage interest payments. As your partner is working you may not recieve anything.

Honestly, you really need to contact Shelter. I've had a quick look and there is loads of information on repossession.
