I had an accident about 6 months ago, it is still not settled.
This is what happened. Sorry if it seems long but I'm trying to be clear.
I was driving in the left hand lane of a 40mph duel carriage-way and had to stop for a parked vehicle blocking 1/2 of the left hand lane. The car next to me (a taxi) in the right hand lane slowed down too for no reason that was apparent to me. (Unless he thought I was going to try cut him up and pull across in front of him?) Anyway I slowed to a stop.
The car behind the taxi swerved across into my lane and came straight across the back of my car (writing it off) and he continued into a tree on the left pavement. Meanwhile the guy in the taxi looked across to see if I was ok and drove off because luckily he hadn't been hit.
The driver who hit me came up with some elaborate story that I pulled out in front of him inbetween him and the taxi (that was parallel to me at the end of the accident because I remember looking across at the taxi driver). The other guy's story doesn't add up. His car had crossed from the right hand lane all the way through a wide left hand lane (hitting me) and into a tree on the left hand pavement. BUT if (as he has alleged) I pulled out to the right. Surely the force of my car would have shifted him into the righthand embankment and not about 12 metres to the left.
Thing is I think he intended to undertake the taxi as it slowed down and didn't see that I was slowing down for a parked car in my lane.
My car insurance company say it will be 50-50 blame. The witness in the park car claims to have seen nothing. Not even the taxi. I had no camera so took no photos.
I've have never known anyone get hit in the rear and get half or any of the blame!!! What can I do? My insurance company (named after a popular gemstone) won't fight it? I had bad whiplash and back (muscle) injuries and want the relevant compensation!
I really need advice on this because it's really getting to me that an accident that seemed to me to be so clear cut (ie someone goes into the back of you... they should leave distance etc) is apparently not so simple. My insurance company told me "It's complicated to understand" but it's really not. I used to work at flippin Esure!!!

Looks like in your case the relevant compensation will be half of anything you would have been awarded had this not gone down as half your fault.0
