Incorrect default date on credit report

Hi, I am looking for some advice, i defaulted on a loan in 2002 and after recently checking my credit report i have noticed that the default date they have is 2008. Is there anyway i can have this corrected and what would be the best way to go about this?

    Do you have proof it was defaulted in 2002? do you still have a copy of the default notice from the creditor from that time?

  • Hi, i dont have a copy of the default notice i think i might have a copy of my bank statements from 2002 which would show the last payment i made to them but not sure if this would be any use

    There are some OFT guidelines that say a default notice should be placed within six months of you defaulting on your agreed repayments. So there may be something you can do, will see if I can find a link for you......

    was the default placed by your creditor or by a debt collection agency? can you tell from the report?

    do you have a copy of your credit file showing the original default date? I had issues when i defaulted in 2002 and they sold the debt to a dca. when the dca registered the default in their name their systems put the date of default as the date they changed the creditor.

    If you subscribe to one of the cra's and check your file regular you will have past reports for 12 months on there. All i did was call the dca told them the data was incorrect, after a snotty 10 mins or so i had to cut and paste the entry into paint and email the dca manager, he looked at it called me back, agreed the default shouldnt be there and it was removed within 24hours. I did say i had contacted the ombudsman etc but was trying to reslove it directly prior to commencing any action.

    Out of interest who registered the default originally, has it changed ownership since? who now shows in the default entry? when did the date change?

    If you have access to past credit file this can be sorted out in no time..if you dont it can still be sorted, maybe asking 'never in doubt' to have a look at it for you... he helped with issues i had before, great guy and knows an awful lot HTH
  • Hi The default was placed by a dca Tessera, i was originally getting letters from a company called Rockwell, i believe they may be the same people. In my past credit reports it did not show as a default at all just in arrears 2008 was the first default date registered.

    It appears that the lender never defaulted you (they do not have to) - but when they have sold it to the DCA the DCA have then went and defaulted you! Sounds like this has happened in your case, unfortunately.

    What you need to be doing really, is working out when you last paid them - i'd be guessing if you've had no contact (i.e. not paid) since 2002 then the whole thing will be Statute Barred anyways......

    You really need to try and establish some facts, moreso whether you were defaulted by anyone else in the past (over this debt), when you last paid (this debt) and what exactly have you received over the years, i.e. have you seen a default notice or a notice of termination?

    I'd be looking at Statute Barred before anything, so first question - when did you last make a payment to this debt, approximately?

  • I have checked back my bank statements and the last payment i made was on the 16th of August 2002, i have only had letters from a company called Rockwell, and on my credit report it says i owe the money to Tessera but i think they are the same company. I have made no contact with them i had thought about statute barred but was not sure if this was the best route to take.

    Are you sure the two relate to the same debt? Do they give figures of what was owed? Do the figures tie up? (later one = earlier one plus interest or charges)

  • Yes it is definately the same debt and the figures tie up i looked up the website for Tessera to get an address and it said that they are also known as Rockwell and Fenton Cooper.

    Before we jump in with Statute Barred go back to your credit report (or statements) and please confirm the following points then we'll be able to finalise this for you:

    1. What was the exact date that you last made payment (16/08/02)?
    2. What is the exact default date as shown on your credit file
    3. Who was the original creditor (i.e. the lenders name)
    4. Who is the name as registered the default (i.e. what is the DCA's name)

    Basically I need you to come and say the default date is after 16/08/2008 - if not then they may have got away with being sneaky but i'll confirm later for you when you respond to the points above....
