allegedly over-refunded, can they ask for it back?

My company hired some blasting equipment and bought some sand to blast with. As we had not used the company before they wanted paying up front for the hire of the equipment, a deposit for the equipment and also the purchase of the sand. They would then refund me the deposit for the hire and also refund any bags of sand that I didn't use as I have never done it before so was completely guessing how much to purchase. This money was taken on a credit card.

After the equipment was returned, along with 11 unused bags of sand, they refunded me.

After this refund I had a letter saying that I owed them £136 for the sand that I had used.

I sent them a letter to say that they had already charged me for this (which is what they said they would do over the phone when we agreed a price) and that I wouldn't pay.

I have just received a letter from a debt collection agency for the money. Do I have to pay them the money that they should of taken even after the refund? :mad:

  • If this is a business transaction, why did you pay for it in the first place, your business or employer should have done so.

    How long has this matter been goin on, debt letters do not just appear. I suggest you contact the hire place and discus the original invoice and terms asap.

    Or you could leve it for another period of time, hide your head in the sand you've got and hope for the best

    If they have made an error and you have not paid for the sand then of course they could expect you to pay it back. You should have refused to use your card and made it a B2B transaction.
