Can I claim?

Hello All
What do you think? In January 09 I began a new job however, due heavy lifting at work I had a bad back and had to have an operation to remove a disc! Because I had only just started and was still in my 6 month probation period, I was only paid 4 weeks sick leave and was not paid anything else until I returned to work in September. My question is do you think I can claim sickness benefit for this time that I was not being paid, I was still paying the childcare and I do not received Child Tax Credit or Working Tax Credit as I was previously overpaid. Is it too late do you think? :eek:

Its a long time ago now, it depends if sickness benefit allow backdated claims, i would think it would have to go to an adjudicating officer to decide and you would probably have to have very good reason for not making the claim before now.We love what we are doing and we love why we're doing it!!0

Hi, taxcredit will backdate upto 93 days. was your taxcredit claim stopped?? I dont think you can get sickness benefit backdated to that period0

Someone else may know better but, as far as I know, your employer should have paid SSP to you? I might be wrong, but I'm sure somebody will clarify.0

what we need to establish is did the OP continue to send in sick notes? until s/he was fit to return to work.
Statutory Sick Pay (SSP)
Most people who are ill and unable to return to work are eligible to receive Statutory Sick Pay (SSP). This is the minimum amount employers must pay you by law (including during any probation period you may have). To be eligible to receive SSP, you must:- Earn at least £95 a week, or £97 a week from April 2010
- Be between 16 and 65 years of age
- Have performed some work under the employment contract
- Be sick for four or more consecutive days
You can get SSP if you work part-time, on a fixed-term contract or you're an agency worker, but not if you're self-employed. However if you're self-employed you may be able to claim ESA.
How to claim SSP
Once you meet all the requirements for receiving SSP, your employer will supply you with the proper documents to make your claim. For an absence of a week or less, a self-certification form completed by you is usually all that is required to confirm your illness. After a week, you need to provide a doctor's note.

Thanks for the replies. I did not receive any SSP at all during this period. I had nothing to manage on but my savings. Do you think it is too late. The reason I didnot ask before is because it never crossed my mind!!! Just muddling on. Daft I know but I was so concerned with keeping my job that anything else didn't occur to me.
