    Getting an injunction

    A friend of mine will be able to do this for you.

    They do however reguire £10,000 up front to cover their costs.

    It might be better to talk about how to resolve the issue, always assuming you are willing an able to pay the debt you owe. Obviously if you are unable then there are helpful threads on the site.

    I am grateful for the time everyone has spent in reading this thread, even though the replies left have missed the point I've raised and levelled criticism at me for being a "can pay but won't pay"

    The "can but won't" has only really come about because I needed time to get my house in order and have done so else where without being driven mad by people who seem to think that behaving like this I've been able to think about solving my problems.

    I DO respect the views of other people, after all, I have invited them - and perhaps because I've managed to convey just how unhappy I am, I've given the wrong impression of myself. But hey - you don't know me.

    Part of why I've done what I've done (that is my part in the stand-off) I suppose is in my make up. But hey-ho.

    The debt will become statute barred in 2012 (provided I don't write back to actually acknowledge the debt, that is) which is another 2 years; I suppose I have a long wait of being told "If you don't do this, then we'll ...................... " for another couple of years or so.

    I have read the 1997 harassment act but if a company can behave like this and when it stops because it can't practically continue, if there is no form of redress from that law then what is the point of having it?

    So, one last time, even though for the sake of argument I'll assume you're all right and that I am a head case who deserves this abuse, can someone explain what I would need to do to get an injunction? Or should I see a solicitor?

    You should see a solicitor. You could try for an injunction on your own and the court papers used to be £120 to file. But either way you do risk the application being refused and costs which may dwarf your debt - you also risk you opponents taking it this way to be vindictive, And you do beg the question - not here or from me, but in court - of how you can afford the legal case and not repay the debt.

    Couple of things. At the time when I was getting all these calls and that drove me mad, I was a couldn't pay for sure. I owed other creditors more money at the time. So why should I have chosen not to pay JUST this one?.....

    As for affording an injunction. The thread was intended to find out what it would cost. The opinions expressed on here is that it's something which I can't.... So the law is a bit of a joke: It says that it is a criminal offence with civil remedies if any one behaves in a way in which they know or ought to know that their behaviour is leading to the serious distress and upset of another - which I assure you all they managed during 2006.

    HOWEVER, in spite of these antics, I made arrangements which I have stuck to with every single one of my other creditors {none of whom have told me I'm a splendid fellow when it became apparent I could not meet my commitments}, where I explained my circumstances and reached agreements with them all in turn.... I will be debt free elsewhere in around 3 years (I did have around £20,000+ in 2006 - EXCLUDING this matter it's now less than £8,000 but I am paying all the others what I can in amounts I can afford).

    I ask again - what should give any creditor carte blanche to abuse a debtors teephone service with hundreds of phone calls as a tactic to try to elicit either preferential terms or unrealistic repayments considering the means of the debtor? Being in debt DOES NOT mean anyone can dispense with the law and do as they please! Or does it?

    Believe it or not, I do have a conscience and morals but why should I pay these people anything and let them off the hook and REWARD their behaviour? Or is the view that they can dispense with the law as and when it suits them?? Sure, my being in default when I could do nothing about it wasn't pleasant - but are the rest of you honestly telling me what they did WHICH I CAN PROVE doesn't matter???????????????????????????????????????????????
