    Thanks Jules. Can I ask what happened when they did not accept? Do they charge you more interest, send letters, call you send balifs round? I owe them £7500 which is a third of my overall debt so I will struggle if they don't accept. xx

    They have put ridiculous charges on, which is one reason why I am trying to knock them down for a full and final settlement. They have said they will accept £2800 on £3500 debt. They passed it to their internal DCA three months ago. We have just kept making payment. Interest has stayed at usual 39.9%:eek: No sign of CCJ papers or default as yet.

    My interest with HFC and Natwest has stopped been charged but Sygma/Creation are a nightmare.

    i was late doing my annual review and have suffered over £200 in charges for May 2011, even though my circumstances are the same (Well except for food, fuel and gas etc etc going up!)
    Furthermore it has just struck me that my 7 year DMP will end up being 44 years if they continue to charge the same.

    CCCS have advised for me to write to them again, see below

    I am writing to complain to you with regards to a number of issues with my above account particularly concerning the extremely unfair interest and charges you apply.

    You have recently written back to my letter dated 18th June 2011 and I have quoted your reference above. However I still feel you have not resolved this issue in full and you have not understood my letter properly, so I have outlined again my main complaints;

    1) I have paid you £1310.81 since September 2009 and yet my debt with you has actually INCREASED considerably.

    2) On your statement dated 7th June 2011 you have charged me £209.70 in a single month against my usual payment of £72.31.

    3) I still feel your monthly interest of £57.44 against my payment of £72.31 is hindering my ability to clear the debt.

    4) Every other company on my debt management plan has frozen interest to help assist me to pay the debt off. Please could you do the same for me?

    5) I genuinely believe that your interests and charges are extremely unfair and as a consequence are clearly hindering my ability to pay this debt off

    I would really appreciate a clearer response to the above.

    I understand and that you must send a written acknowledgement of my complaint within 5 business days of its receipt. If you are unable to resolve my complaint within 4 weeks you must send a holding response, explaining the reasons why and indicating when you will make further contact.

    If you fail to resolve my complaint within 8 weeks, or if matters are not settled to my satisfaction, I will have no alternative but to escalate my complaint to the Financial Ombudsman Service.

    Obviously, on my part I will continue to make my monthly payments from CCCS.

    Does anyone out there think i could improve on this letter as Ive been up working on it since 530am and that really isnt healthy??!!!

    The only other way I can think is to go down the route of an IVA?!

    I have recently taken my head firmly out of my own @rs* and contacted CCCS, my first payment will be taken on the 10th August. What a rollercoaster of emotions! One minute I am feeling relieved and the next worried, guilty and confused.

    Some of my creditors have already written to me accepting payments and freezing interest and charges! However I have received two letters today from CCCS informing me that Natwest (one for an overdraft & one for a loan) can not accept my repayment proposal due to: contractual payment required. Does anyone know what that means? CCCS mention in the letter that I do not need to do anything and that they will continue to send the payment but that natwest are likely to default the account and pass it to a debt collector.

    Argh! I am trying my best, does this mean that they haven't accepted my budget? (that I agreed with CCCS and isn't excessive).

    I have been reading all your posts, thank you for taking the time to share your experiences, it has helped me enormously to see that I am not alone. I am too embarrassed to talk to my family about this.

    Please take some time to search back through the posts, all of these questions/fears are dealt with in some depth - In short, creditors are under NO obligation to accept your proposal, some do and some don't. At the beginning of a DMP they will often refuse in the hope that you may cave in and pay more, they may even be a bit aggressive in this approach. keep paying and hopefully they will accept but DO NOT offer more than your plan affords you. Defaults are better earlier so do not be worried by these. Creditors can take you to court, not so likely but it does happen (I know it happened to me) -You have to remain focused on the long term goal, the road will be bumpy but the longer you demonstrate your commitment to pay the better your chances of a smoother ride. - Hope this is not too harsh but many posters ask who accepts and why, the answer is that no one creditor accepts everyone and defaults everyone - I think it depends on individual circumstances and the creditors status at that point in time :);)

    90% sounds WAY too high. Would go in about 25% if you feel brave enough.
    Search the PayPlan site for advice, maybe phone them? Would certainly not show such a strong hand to your creditor in the first instance,
    You've paid your dues and more over the years, so be strong and be prepared to barter.
    I might also be in a position to ofer F + F's shortly due to a legacy.
    But it feels like blood money - every day I miss my Mum, and hate the thought her frugal ways might ease my money situation.

    Thanks, Twitty, I will. I think I had that info rattled in to me at the start, with the warning that 'You better make sure you have the money if they come back with a counter offer...' and I'm not really sure where that came from.
    I totally agree that the money seems like blood money - if you knew the lady we were talking about, you would think she hadn't tuppence, bless her. It just goes to show how much money older people think they need to (dare I say it) bury them. I had no idea how much a funeral was until recently. You really live and learn,

    I have been reading about people sending gesture payments to creditors. I remember seeing something about this is CCCS pack but did not do it as I literally have £10 until payday in a week and a half. (Not including food, cupboards are full)

    Will it be ok to send token gesture payments next week? I have an early birthday cheque for £50 so could use that once I put it in bank. I have already sent the letters (last friday) saying what my situation is but would it still be ok to do this now? Also, how should I do it? Online or by cheque or postal order.

    Any advice would be welcomed. :)

    Hi Sam, welcome, and in answer to your question, I would send £1 postal orders to all your creditors. Not sure if your payments are due, but it lets the creditors know that you haven't left the country and gives them something to work on.
    As I (and lots of others have learned here) maintaining communication with your creditors can really get you out of a big mess. Especially when most of their letters are computer driven.
    Keep posting, it sounds as if you are doing well, and staying on top of things,

    Hi Wolves, Sorry things have been hard recently, try not to panic yourself into IVA territory by stress alone! Isn't it dreadful how things seem so much worse in the middle of the night?
    When you start out on this thing (not using the J word!) you don't realise how it takes over your life. Perhaps it's because you don't take on board how big it all gets, overnight, when you can't pay it back.

    There are people who understand the letter writing part of this, and how you word it, better than me, along soon, but I just thought you needed a bit of encouragement not to give up hope just yet.

    Hi Lucee, I'm so sorry I don't know about contractual payments either! Having said that, I'm sure I missed a few! My reply was simply to say I'm glad this thread has helped you, you are welcome here, and if it is any help, my family still don't know either, (and we are 2 years in).
