I purchased a semi proffesional hand held car polishing machine in July 2008.
I didnt get round to trying to use the machine until a few weeks ago and the machine worked for about a minute then stopped never to work again.
Silverline are the manufacturer and the instruction book states the warranty lasts 3 years but return costs are at my expence,
Problem is this machine is ver heavy and would cost a fortune to return.
My question is should I be attempting to return the item to the retailer or the manufacturer as I have not had reasonable use of the item
and
should I be liable for the return costs?

If your returning under the manufacturers warranty, then they can impose any costs they want so yes you are liable.
However, if you return it to the retail under the sale of goods act, they are liable for all costs associated with a remedy.
Its also worth noting that the easiest option may be to go to the retailer and ask them to send it to the retailer.Back by no demand whatsoever.0 -
Purchased over the net so retailer is just as far away as manufacturer.
So am I right in thinking I can return it to the retailer under Sle of Goods as it has not lasted a reasonable mmount of time.0 -

Yes and no, your not guaranteed a refund if thats what you mean, your merely entitled to remedy. How log has it been since purchase?Back by no demand whatsoever.0 -

What a totally pointless piece of advice that is. A great way of putting people off using a help forum!
Nothing states you need to use anything as soon as you buy it.
I have the right to a repair with the manufacturer but wanted to return to the retailer as they would be liable for return costs where the extended manufacturers warranty makes me liable for costs.
I wanted the advice of the genuine sensible users of the forum.0 -

You have the right to repair if the fault is INHERENT under SOGA, they would be in their right to ask you to prove that the fault is inherent (as it is over 6 months since purchased) and not from your misuse (lack of use may come under this) or wear and tear (unlikely in this case)The Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
