Do online retailers have to honour selling price?

Hi.

Little problem with a retail web site.

I bought an item and only paid for delivery as the price for the item was £0.00.

Now they refuse to send the item and are telling me they can keep 15% of the delivery price that i paid for to cover their credit card charges.

I would like to know...

1. Am i entitled to the item even though they made a mistake in the price?

2. If i am not entitled to the item am i entitled to a full refund of the delivery charge that i paid for.

This is really stressing me out as the item was meant to be a gift for my 5 year olds birthday and until i dont get my refund it will be difficult for me to buy a replacement gift. I lost my job recently so having to tighten my purse strings :(

    1. Probably not, dependant on the t&c's. However most state that contract is not formed until dispatch so its safe to assume that you have no rights but double check.

    2 You are entitled to a full refund of your delivery under the distance selling regulations and this practice is illegal. Its their error so you are not liable for the costs and state you will get trading standards involved.

    On a side note, theres nothing truly free in this world so why you thought this was a good idea i dont know. In future avoid these things as you will only ever have hassle getting a refund.

    Fantastic - some chancer has come along trying to take advantage of a pricing error to get something for nothing, and this retailer decided to hit them with a 15% charge for being so cheeky... great... they are not allowed to keep the 15% though... shame!
