    Hi Ann

LOL, it is complex! I'm struggling cos there are 8 different rulings with various factors written into each so trying to make sense of it all, is ermmm, let me say not best easy!! :o:o

    See here:
    - McGuffick v RBS - Case & Judgment Breakdown
    - Carey v HSBC - Case & Judgment Breakdown

The McGuffick one is finished, you should be able to read it and make sense of it - just by the conclusion at the bottom! However I done it so the lenders can learn from it as well - cos they seriously have mis-interpeted the actual judgments, some of the letters people have been getting astonish me, I mean its a joke! :rotfl:

Anyway, onwards and upwards - back to the Carey judgment for me (for the next 4 hours lol) :):)

    Will have a look Niddy!

It does seem like a lot of hard work - but I am sure it will be appreciated by large number of people, including me! Especially if lenders are sending out letters with the wrong information in them! Probably just as well that they DO lurk on here!

Been going through the mortgage DSARN AGAIN........from C&G, as we remortgaged in 2007, received a letter back as well this morning in relation to a letter I sent them.

What is a DSARN? It is called a SAR (a s.7 DPA1998 request lol) - forget what the banks call it, the official and proper name is a SAR. :D:D

The application income details are wrong and not hand written like the main of the form, where some are hand written by the adviser at lloyds and the rest of it possibly underwriters, but they had my hubbys income on over double than he was on.

Who completed the form then? if it was not you or hubby and the salary is inflated this could be by the advisor to cover the fact it was approved, as usually affordability would surely affect the decision - i.e. should have been a decline, yes?
    di3004 wrote: »
I did write about this when we first received the DSARN last month, and the letter received today stated, that they went by the previous year by bank statements, and not by the current time of taking out the application as such, because my hubby did tell the adviser the plant were making redundancies, ages dropped due to no work and shifts went to days, so allowances were stopped and then a few months down the line the company went into administration!

Does the data tally with last years earnings or is it bull shoite?
    di3004 wrote: »
However, I have calculated the bank statements from the time they said they did and they are still wrong and overestimated.

Ok, so you need to refer it to the FSA and the FOS
    di3004 wrote: »
They have £28K down for hubby and £11K for me, well I was only receiving the children's benefits and hubby brought home less than £16K, they then said they worked it out by £21K as this is what it would be as Gross wage!

They do not calculate using Gross - muppets, benefits are not PAYE and therefore should be calculated as source, i.e. £200 is £200 not £240 Gross/£200 Net - :rotfl: :rotfl: - The bank know this, they are taking the michael here ;)
    di3004 wrote: »
How on earth could It be on that stated amount!

    Exactly!
    di3004 wrote: »
How do they work that out, they did not want to see anything at the time of application, and stated they had gone by the bank statements.

Its still wrong, something does not add up here at all.....
    di3004 wrote: »
For curiosity, should they be taking the children's benefits into account for a mortgage application anyway?

Only if it is guaranteed - for instance benefits cannot be included (i.e. JSA etc) but things like Chb can be as these are not affected by income, ie they are not means tested! In answer, i'd say no they should not be included, as the norm...

There is more to it, I could go on for ever!!! oops sorry for my long post.

You need to go to the FSA and FOS (click for the relevant forms). :D

Have just read Niddy's latest missives!

Not light bed-time reading, by any means!

One small question, did the banks or the debtors initiate the proceedings? And, in either case, who was responsible for the legal fees? They do not sound like cheap, straightforward cases - at least to me!

Its easy to understand just hard to summarise!

They were brought by CMC's (claims management companies) on a no win no fee basis. They all lost btw so they all went under, near enough! :rotfl: Will explain that - thanks, never thought to mention it.... :D
