David Lloyds Cancelation

Hello,
I need to cancel my david lloyds membership as I can no longer afford it. They have a 3 months cancelation policy where by you must give and pay 3 months notice before you quit.

Here is my question. On the Membership agreement my name is written under lead member However as I was 15 at the time my dad signed where it says "lead member signature here". Is this signature valid? as it should be mine?

Also None of my dads details are on the membership agreement such as name address etc. Do you need to have you name on contract you sign to make it valid?

Also they have changed the membership price and they say they will "give you advanced notice of changes" As my dad signed the agreement but my details were on it should they have sent a letter of a price change to my dad aswell as?

Thanks - James - Any help greatly appriciated

As you are 15, the contract appears to be a valid contract between DL and your father for your membership. Don't waste too much time and effort thinking about arguing about validity.

By raising the price, DL have made a 'material change' to the contract, which means that you can leave without penalty. There are 2 ways they can let you do this
    • Let you give 3 months notice, which you pay at the old rate, while continuing to have use of the gym
    • Let you leave immediately
This is their choice. But they will probably want to make you serve out 3 months at the new price. This would be wrong because it is 'unfair' - you will not be leaving without penalty. If they let you give notice, then keep a copy of your letter. If they let you leave immediately, then make sure you get it in writing - or write your own letter to say why you have left and that they gave permission.

Be very careful to do this correctly. Gyms are notorious for being quite nasty - if you just stop paying, they may just come after your father with debt collectors. They may do this anyway, which is why you must get it all in writing and keep copies. Do keep your father informed at every stage. And never hand over your paperwork.
