Currys and Dyson

I bought a dyson vacuum cleaner DC24 on 25/05/10 and on getting home and setting it up, I realised the noise from the cleaner was too loud and unbeareable. I immeadiately called Currys that I need to exchange it as i could not bear the noise because I suffer from migraine. However, currys told me they cannot and will not exchange as I had opened the pack. I called Dyson only to be told because the model has two motors in it, that is why it is loud.....hello! it was not demonstrated to me in the shop neither does it state the level of noise in the advert.
As far as I am concerned, it is not fit for purpose as I am unable to use it. I have been to currys twice all to no avail as they maintain Dyson will not refund them if it is exchanged. All this within 2 days of purchasing it. I just came off the phone with Dyson and they say I will be charged £25.00 for an engineer to come out and check it.
Where do I stand, please advice.

Just because you don't get on with it doesn't make it unfit for purpose or in anyway faulty. Currys are well within their rights to refuse to accept it back.0

Why don't you ask them to demonstrate another DC24 in store to satisfy yourself that yours is not faulty? This would also highlight if Currys are able to offer a buyer a reasonable opportunity to inspect the goods.
When you say that the goods are not "fit for purpose" does the vac not clean? Were you offered any assurances of noise level and did you specify that the vac had to be quiet in operation? It's a bit unreasonable to expect Curry's to know about your medical disposition.My farts hospitalize small children0 -
If noise was a major factor for you then you should have checked this prior to purchase.
How where currys or dyson meant to know about your noise requirements?
Unless its faulty you are not able to return it and faulty doesnt mean simply being too loud for you.0 -
I have the D25 animal, and it is noisy, but works really well!
Too noisy for your liking isn't a fault, so you have no right to return it.
Either sell it on, or buy yourself a decent pair of earplugs for when you do the vacuuming. Problem solved!Should've = Should HAVE (not 'of')
