Working tax credit

Hi Eveyone,
im sorry if this is in the wrong place.
I have just renewed my working tax credit and was told by the operator that my partners incapacity benefit does not need to be included as income because he has been receiving it since 1994. And that it should not have been included for the last 2 years. He flagged it to be investigated and said i should get some refunded. He put me through to another department where i was told that we would get nothing as it was my fault. I doubt it would be much but who is right?
has this happened to anyone else?

They probably are. Dont think they can backdate for that long anyway, but, you recieve guidance notes with your renewal form. It is your responsiblity to read the notes, use their sheet to work out applicable income and put the correct income figures in. If you gave them the wrong figures they'll say it's your fault for not reading the notes. Cant really be their fault, which would mean they would owe you something, because they took the figures you gave them and did what they should have.0

I filled in a form the first year, last year i did it over the phone. At least we are ok for this year. I am just thankful he asked the "when did he start getting incapacity benefit" question, otherwise we would lose money for another year.
