letter to the agency - rent increase

    If you wish to remain, I would tick the box and send the letter back. You're not making any commitment other than expressing a current desire. The LA next step will be the new t/agreement, which you don't have to sign.

    1 year ago: We have seen the flat, we paid a holding deposit.
    The next week we went to the agency to sign the contract: they have given us: 2 copies of the contract, the S21 (I asked what is this for: and they just said something about their safety if the tenants turn out to be bad people). We signed all.
    We moved to the accountancy department, gave the card and paid the rest of the rest of the rent and deposit. We were given a inventory to check at home and sign and send back.

    6 months ago: they sent a similar letter (without the rent increase part), we ticked that we want to "hold on", we were sent another piece of paper signed by the landlord that we had to sign and return. (I have to digg it out)

    this week: this letter, I have phoned and asked what they mean by "the rent may increase" and a lady from the agency said that it's usual a 4% increase and I could try to write a letter to the LL.

    So the S21 applies to the original tenancy and not the renewed tenancy. Hence it is not valid.

    Just to be absolutely sure, when were you notified about the deposit being protected?

    I will have to digg the paper at home. I think it was after we moved in, but it may have been in the same they as the contract, they were loads of paper to sign and we went to the agency at 17.30 so we had to rush... I will digg it tonight.

    I really appreaciate your help, it really good to know that it's not compulsory to sign every 6 months...
  • Unless the date on the protection notice was BEFORE the date of the S21 (VERY unlikely), the S21 isn't valid. If you've signed another tenancy agreement SINCE the issue of s21, the s21 isn't valid.

    no, the new piece of paper wasn't the S21, it looked like the contract, but shorter

    If they are the same, the s21 is invalid. In this context, the law does not recognise fractions of a day and the TDP needs to be complied with BEFORE s21 can be issued.
