Recieved Same Item Twice

Hey all,

Just looking for a bit of advice on an issue I've currently got. I work as a door supervisor and as such, I choose to wear a stab proof vest. I've had one before, but I sold it when I needed the money. I recently decided I wanted a new one and I ordered the same vest from the same seller on ebay I'd used before.

It came a a few days ago and I noticed it seemed a little smaller than the one I'd had before, but I wondered if I'd just put on a little weight. Anyway, I was thinking about getting in touch with them and double checking they had sent the right size, when another one arrived at the door, I tried this one on and it fitted perfectly (the right size).

Now, I'm a bit confused about what's happened, because I've checked my ebay and my emails and I haven't recieved any messages saying they've sent me the wrong size and I haven't been in touch with them. If they had realised they had sent me the wrong size, I would expect them to either not get in touch and hope I don't realise, or get in touch and arrange an exchange.

Now... I know that a lot of people are going to say I should ship the item back because it is the right thing to do, but to be perfectly honest, if I can keep it, I'd find a good home for the spare. What I'm wanting to know is if I legally have to make an effort to get it back to them.

I've done some searching and people seem to have mixed opinions. Some say that because I haven't paid or requested it, its unsolicited, which means I have no obligation to send it back, others are saying that if you know it shouldn't have been sent to you and you choose not to send it back, then its theft, and a lot have said you need to give them reasonable time to pick it up (28 days) and if they choose not to, then its yours. But there seem to be so many different people who have a different opinion on the matter.

I was wondering if anyone could clear up the matter...

    Well the honest and right thing to do is contact the seller and arrange for them to pay for the return. What's right and wrong in law doesn't really matter it comes down to are you an honest person or not.

    There's probably another doorman somewhere wondering where his is, let's hope he doesn't have the need for it while waiting for his order. They have obviously made an honest mistake, it would be nice if you if you did the honest thing.
