Great news. OH just rang me to say that a letter just arrived from Enterprise to say that they will not be pursuing the case and could he sign the letter and return it. I think they must have missed the date to pay the court fees or just realised that they were on thin ice. Anyway I am so glad this is finished at last!!! I would recommend anyone hiring a car from Enterprise be very careful. Thanks for everyone' advice. Hoorah.0 -

The letter from Enterprise's solicitors says:-
Dear Sir
Re Enterprise rent a car uk ltd V yourself
We refer to the above matter on which we have recently been considering matters with our client. Having considered matters further we can confirm on a without prejudice basis that our slient is prepared to discontinue their claim against you. In order to do this, please sign the enclosed Consent Order and return the same to us so we can sign and file Consent Order at court ( this will then bring the proceedings to an end).
We look forward to hearing from you.
The enclosed form is called a Consent Order
and says
By consent it is ordered that ;-
1. Upon the parties reaching terms of settlement the Claimant consents to discontinuing the claim on a no Order as to costs basis.
We hereby consent ot an Order being made in the terms set out above.
There is then a space for my OH and themselves to sign.
Can anyone tell me if we should sign this or take further advice first??0 -
Just a quick update. I telephoned Enterprises's solicitor and spoke to the man dealing with the case. He basically told me that he had recently taken over the case and (speaking off the record) had advised his client not to go ahead. I presume from this that their case was as flimsy as we had though all along. He asked my OH to sign and return the form (mentioned in the previous post) in order to close the matter and I said that we would take advice from the CAB first. He also said that the original court date of February had been changed to August because there was some technicalty that had been dealt with wrongly???
Anyway it seems theye were in the wrong all along. I am about to write to Tesco with copy letters to ensure they do not take the £500 excess again.
I heard on the news that Manchester is going to have a congestion zone so beware!!!0 -
Hi Rose,
You will OK to sign and return the form it is just what it says - a consent. If you where going after them for a lot of money you would need to take advice. Since you are not it just lets them wind it all up and lets the Court know does not need to allocate time for it because it has been settled out of Court by consent of both parties.

I was talking to somebody from the Durham area on Saturday and he said he had heard they had removed the bollards because of all the problems they had caused. If my family and I had not suffered so much stress from this incident I would have considered suing Durham City Council for damages. Anyway more good news- our son was in accident outside his school 8 years ago and broke his arm. He has since had problems with his shoulder dislocating all the time and 2 years ago had to have an op to put a pin in it. He was insured whilst at school and they wrote on Saturday to say the consultant has written to say there is a link between the accident and his shoulder problems and they are going to pay him £3450.00 compensation!!! He has just graduated from University and is off to his first job in London next week. The money will pay off some of his student debt and give him an emergency fund. He is so pleased!! Hi Just a quick update. Sent back the form to solicitor after getting advice from CAB. Will just wait for confirmation from their solicitors that the case is closed. Hurrah!!! Also spoke to Tesco cc this morning and they confirmed that Enterprise had not tried to take the £400 excess again from my card so that is closed. I have just realised however that they have not given me back my £100 deposit that was paid at the time. I will call the solicitors and ask him to get this sorted too. I then intend to send a strong letter of complaint to Enterprises MD!0
