DVLA - Car sale issue!!! - now I'm going to court!!

Hi all,

in August of last year I sold a car, it was declared SORN, as it should be etc.. buyer cam collected car and next day I sent off the parts to the log book to say car had been sold...

a few weeks later I get a 12months TAX disc for the car I had sold.. So I phone up DVLA, and ask what I should do and why I had this tax disc...

it was explained that there records still showed me as the owner, but allowed someone to buy tax online, but disc goes to owner address, I explained I did not own the car, and asked if I should or could do anything to get this cleared up... I was simply told to return the tax disc with no further action on my part...

then in a short time later I get a letter telling me someone is trying to register ownership of the car I had sold, so I phoned the DVLA again and said this was fine as there the owners of the car.. I again asked what I could or should do, and was again informed that I should take no action, and the registration would automatically swap over unless I contested it... again thought this was the end, given I have owned 5 cars in the last 2 years, I am fully aware of what I need to do on selling a car...

anyhow in feb of this year was contacted by the DVLA enforcement stating I had not declared the cars sale, and could contest or pay the £55 out of court fee.... so I contested - only to be told "we don't find in your favour.."

So I phoned up to get an explanation as to why when I have done all I could, find myself in this situation…

this saturday I got a letter, and am due in court the end of the month to be charged with failing to notify the DVLA of car sale..


help and advise please - As I am at a loss...

    Yeah they're sods for this, there's no way out, they have all angles covered.... It's nothing more than legalised robbery.

    They had me for failing to notify even though my insurance company had asked for and taken my V5 (written off). I explained and they fined me for something else instead...... :mad:

    There are lots of cases where people have won in court though, im sure someone will come along soon with some examples.

    The DVLA are getting hammered in court over things like this!

    It isn't just private individuals either, she who must be obeyed works for the equivalent of the DVLA here and has no end of bother with the idiots in Swansea who constantly write in or ring up demanding details of Manx vehicles that have been sent to the UK with legitemate export certificates, they know full well we do not have MoT's nor do we have the UK vehicle license system, the same type log book any type of insurance data base or even any HPI checks, they also seem to think they can demand data on a vehicles road tax situation that has been exported from the UK with an export certificate issued by them and is now under a Manx plate. Swansea seems to be manned by a collection of buffoons assistants with the collective IQ of a !!!!!! rocking horse, no wonder your new government want to cull the civil service with such an example.

    Get copies of your phone bills for the dates you contacted them this will go in your favour.

    Contact watchdog they did a report a week or two back, Another lost case for them?

    Every time I deal with the DVLA on something like this I am sure to at least follow up with a letter, keep a scanned copy and keep a scanned copy of the special delivery receipt with it. and a screenshot of the Royal Fail website showing the proof of delivery for the special delivery. I do he same when sending off paperwork such as driving licenses and logbooks, including keeping a scan of the original paperwork.

    It's the only way to be safe against this bunch of idiots.

    No government body or agency should have the powers to hand out arbritary fines in this manner - this is another legacy of the 13 years of Nu Labour rule that should be scrapped.

    I haven't got time to post a full reply but it is possible to contest things with the DVLA as they sent me a 'fine' for not taxing a car i had sold 8 months previous. I had sent the log book back and also phoned them when the reminder came through. after a couple more letters they were still saying they had not received it. I sent one further letter in to them and they maintained they didn't receive that.

    I had however sent it in recorded delivery and had a signiture so basically i said it was their own internal mail system that had problems and so therefore how can it be my fault. I received an apology letter soon after stating the case was closed the the fine not payable.

    I say fight them every inch of the way.

    When you sell a car and send off the paperwork to the DVLA you should get a letter back, which they say to keep, which confirms the car is no longer registered to you. If you don't get one of these with a couple of weeks of sending off the paperwork I would phone them to find out why the sale has not been registered. I kept my leter and about 12 months later the police sent me a speeding ticket for my old car. I returned their letter with a copy of the letter from the DVLA, end of story.
