Car Insurance - Mis-sold?

  • My friend is also trying to cancel a policy with the PO which was renewed in March but she sold her car. She was paying monthly by DD and they told her she had to basically pay the remaining amount on the policy in addition to the cancellation admin fee and told her it was in the agreement she signed.

She went back and checked the small print and there was a term saying that all amounts had to be paid if policy cancelled (I can't remember the exact wording). I told her to call them back and explain she wanted to make a formal complaint as this was 1) a significant term in the contract and it was given the attention it warrants in their documentation and was not informed to her as the cancellation policy when she took the policy out; 2) that she feels it is an unfair term in the contract and is excess.

They then told her she couldn't complain because she has no grounds!!!!

    Any advice on this?

I would go back and check the exact wording on this. So you pay more if you cancel mid term than if you just ran the full contract.

Are you sure she isn't close to her renewal date? Usually if you only have a couple of months left you won't get a refund.
