How do you define unoccupied. If the tennant goes back there once a week to collect mail, is that unoccupied? What about once a fortnight?
The official definition is that the owner/ tenant is using the property as their main or only home. That usually means you sleep/ eat/ shower/ store your belongings there at least some of the time. The DWP don't set limits on how many nights a week you have to live somewhere to be classed as a resident. What they do look at is if a couple are behaving as man and wife in terms of shopping, cooking and eating together on a regular basis, but not whether there is physical intimacy. seen the tenant last night ..I asked if he was still living there , he said yes .
I said it looked abandoned with curtains and blinds closed day and night ,the grass hasnt been cut .He still claimed to be living there .He said he spends a lot off time at his elderly mothers house ,but he still lives there .
Then I said but you are not using any electric ,and haven't bought any electric since November .BINGO
Then he said he was living with his elderly mother and calls at the flat every day but hasnt stayed there at night for a year ,but he is there during the day and using it for studying for a church exam .(funny how the church can be usefull ) . I said if I can check the electric useage so can the housing dept and I know for fact that they do check .(that put the wind up him ) ."Do not regret growing older, it's a privilege denied to many"0
