No I agree, however I assumed we were talking about Ebay/Paypal liability.
It is quite another story trying to regain money from a sale (via the legal route) which has gone wrong and in cases of low value, quite inefficient. Which is why the 45 day rule can work in your favour as a buyer and perhaps not so much as a seller, its a free way to get your money back.I completely agree that if it was a private seller then the seller then the OP doesn't have a case
In theory (and logic) with Paypal, he has 45 days regardless of private or business. That's the bit I was getting at.0 -
I think the fact is said "spares or repairs" is the clue. The word "repairs" is plural, meaning you can use the bits in other broken machines.
If the advert had said "need repairing" then I think you would have a case for SNAD, but as it was clearly advertised for spare parts, then I don't think you would win a claim here.

Did you ask the seller if the xbox was banned from xbox live? I sold a faulty xbox on behalf of my bf and I was repeated unidated with people asking questions about was it banned from xbox live, had it ever been opened/attempted repair before, was the seal broken, did it have the red lights (or whatever it is, Ive never played one!). As the person sold it as broken it is just that, broken and unusable, you can use elements for repairing other consoles. If you needed a specific part/function you should have enquired about it.0

Why don't you just contact the seller and ask if they will refund if you send it back? Save all of the hassle asking us.0

Actually I typed up a new post and then my internet cut out on me. I have no problem with the replies. TBH I was mostly just a bit peeved when I came on here in the first place, I'd had a bad morning and it was the last straw!! Now I've had time to think it over, you're all most likely right. I normally do my homework before buying but this was an impulse purchase, which was obviously remiss of me.
I still feel that the issue with the case is valid, as if I had wanted to use it as a spare it wouldn't have been possible - it's barely holding together and there are parts missing. However, I won't open a case against the seller, just let them know that I think they should be more honest with their listings. Thanks for all your replies.0 -
