    Turning right. You can drive into the middle of the junction if the only thing stopping you turning right is oncoming traffic. This was one of the tenets of the 'box junction' when it was introduced with the slogan 'making us all do what the good drivers have been doing for years',

    Which must be me, The police don't want to get involved in these cases, but if you are totally convinced you are in the right, force their arm by creating a scene/issue. If the road is blocked and traffic doesn't move they will attennd, and will come down in favour of one party. But as said, only if you are in the right. ;);)


    Bear in mind that if your car is still driveable by leaving it in the middle of the road you are obstructing the highway which I am pretty sure is illegal.

    Thanks for your comments , I appreciate you only have my 'side' of the story. For those that doubt me may I explain that I am a very self critical person and had i thought this was less than clear cut I would have taken responsibility immediatly.

    I use this junction from all directions on a daily basis. You cannot even begin to proceed without the lights being at red north and southbound. You would lose the front of your car before you had proceeded 5 yards.

    I guess I never thought anything about having to stop halfway across a junction when the lights are in your favour, and i have never seen this put into practice by anyone using this junction, you would be rear ended. But if this is a legal technicality then I will let it drop.

    I was quite shocked when the accident happened and am not forceful enough to put up a fight but know how busy the police are as I often meet them during the course of my work . It has taken me this year to regain my confidence and i drive a long route to avoid this right turn.

    I think I will speak to my insurance company and ask if I can have a second opinion. The current solicitors have made a list of blunders and I have no confidence in them - they misfiled information , told me the third party had accepted responsibilty then told me it was an error and have left personal detailed information on an answerphone that caused my daughter a good deal of distress when she heard it. They even turned out to be using ariel photographs of the wrong junction initially , when they emailed the photo I can understand why they said I had no case but it was a totally different junction with different road markings. I went and photographed it myself for them and sent the photographs recorded delivary and via email. I heard nothing more.

    If another solicitor says something similar I will let it lie, last thing I want is to go to court.

    Thank you for your opinions , sorry if this is a bit dis jointed / rambling, I have had a long hard shift.

    At a traffic light controlled junction there is nothing to say you can't pull forward when the lights are green & wait for oncoming traffic to clear before turning right.

    It's even an exemption for stopping in a yellow box!
    Always try to be at least half the person your dog thinks you are!

    Illegal?, illogical? ineffective? What the heck, you have to get the attention of the police nowadays, they love us law abiding folks that drive away and pay the bills. Rant mode off ;);)

    Quite a lot of differing opinions on here, but there will continue to be differences as long as we don't have the full facts. The devil is in the detail.

    May we see the aerial view of the junction in question? It would be easier for us to put forward a defence then.

    I wouldn't be too scared of court; given that most ineffectual people / companies rely on this threat to get people to back down, those who enter court with their head held high knowing they're in the right and have a good solid defence, usually walk away smiling. That said, get your defence together and it might scare the others into backing down.
  • i agree were just piddling in the wind without any more info, a photo shopped aerial view of jucnction whoul clarify things for us and advise on has strong a defense you would have, you can save the aerial view open in ms paint then arrow your direction and travel in one colour and the other drivers direction in another colour also we will get an idea of how the traffic flows from the picture, or you could give us all the junction name and we can google earth it and do a street view! if your strapped for time!

    This is very common, your waiting to turn right and as the lights go amber you start to move.... THEN some penis brain jumps the amber/red lights either leaving you stranded in the middle of the crossroad or ends up hitting your car....

    In my opinion and if ive read this right, it's such a common occurrence that you really should be the one the insurance company believes.

    This is one instance where an in car video camera would come in useful!
