Original Microsoft Windows 98 SE on EBAY?

I see on Ebay people selling genuine Microsoft Windows 98 second edition certificate with original key product but they are the ones you are getting FREE with your PC when you are buying it...
I am wondering if it is illegal to do that as this is Windows 98 CD you can only use with your PC and not sell it to other people...
can you actually do that?!?!

It would be "illegal" yes, if there is a note attatched "not for resale". It would probably come under copyright laws. Though the powers that be might not want to know, leaving it in the hands of the copyright owner.0

I sold a legit copy of 98 upgrade without trouble. However, my '95 OEM copy was pulled.My TV is broken!

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

It doesn't come 'free' with the PC, the licence and CD are paid for as part of the whole PC price. Microsoft's T&Cs say that the licence is not resellable, but that might not stand up under European law.0
