Exchanging an item bought when 'on offer'

I bought a supposedly good duvet for £20 which a store was selling at half price, so originally it was £40, obviously. After using it for less than a week we find it is clumping together in some areas, leaving other areas of the duvet feeling very thin.

I have emailed the company to reject the duvet but are they obliged to replace it with an item of equivalent value, or just what I paid? The reason I ask is that they no longer sell this item.

    Theyre not obligated to replace anything, if your rejecting then your claiming a refund, replace isnt actually an option but in a lot more cases makes more sense if both parties agree.

    I suspect they will want to refund the money before giving you a £40 duvet but its worth a try.

    You would have to prove the duvet was faulty in the first place (ie you've not washed at wrong temperature etc). Simply showing the store should suffice. If they are good at their job they'd obviously be able to tell. (Not saying you have, just saying they'd need to have the duvet back)

    They are only obligated to refund your £20 (the price you paid) if they cannot replace. Although they will probably try to fob you off by saying it should be shaken out daily and this should rectify the problem and to try that. :rotfl:

    No they wouldn't, under SOGA the onus of proof is on the retailer to prove the goods are not inherently faulty.

    Not really. They bought a £40 duvet for £20 and they wanted to know if they will have to pay another £20 to get a similar quality one or is the shop obliged to provide one.
