    Id pull out. Sounds like a hell of a lot of hassle now, and potential hell in the future.

    Thanks everyone for all your advice recently, I have drafted a letter and will see what happens!!!!!

    Dear Vendor

    I have taken alternative legal advice and have been advised to do one of the following if I am to proceed.

    1) Wait until restrospective planning permission has been granted and a building cert given before exchange.

    2) Reduce offer price to a comparable one bed flat.

    I am no longer in a hurry as I am proceeding with my sale and renting whilst I find somewhere so am able to wait for retrospective permissions.

    I am unable to buy the flat as is. I offered asking price and so far we have had damp and timber problems in the survey, building ins problems, problems with

    the vaults and planning and building reg issues. I am not able to afford to buy a flat that I will find difficult to sell on.

    Yes that's good Natwill.There is no way you should buy it unless it has the relevant PP or building regs approval.
    As sellers and buyers we are all in a hurry to move to our next house,but you have to conform to regs first and if you buy it as is then you'd have a problem selling later on.Stick to your guns.

    Are you sure that you need pp for an internal alteration? No change to facade, windows etc? Can you ring council planning and ask them 'in principle' without giving your address or name?
    Damp too. I'm with the pull out lobby.
    There will be something better out there (or so they say) :)

    Hi I have done the phone call to council several times already!!

    What is shocking is that the vendor has always insisted that lack of pp, building regs,Ins etc etc is all news to him and his solicitor missed it 4 years ago.

    My solicitor who wants me to pull out just found out he bought 4 years ago for far less than my flat was worth at the time…same area, my flat small 2 bed worth 180k 4 years ago…this large 2 bed garden flat sold for 160k!. 4 years later he wants 285k and I have sold mine for 225k.

    She suggests he got it cheap cos of problems as all solicitors will check planning consents and do searches.
