    Just because you haven't heard from them, doesn't mean you won't.

    They can pursue the debt whenever they want.

    What probably happens (and i've seen this done)... usually a company will do an audit maybe every couple of years, they will notice that x amount of cash is missing.

    The next step is to start working out where the shortfall in income is coming from, so they will probably do an audit of the clubs against member count.

    At this point, they will notice they stopped receiving payments from you and since you've technically not cancelled your gym membership (as you can't until the 12 months is up) they will bill you for every month you remain a member.

    But if your smart, you'll go in and cancel the account, pay off the money you owe before this happens, because if you don't, they'll sell your debt to a collection agency and everything gets a lot worse (in the long term).

    Now it may all sound long winded, but it's actually incredibly fast, given that most of these things are computer driven these days.

    No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)
  • Actually, I ended up writing a letter of complaint explaining WHY I cancelled it (had to queue for ages for treadmills after work, changing the classes with no notice so I made a wasted journey) and explained that if they don't want to keep to the contract either then I don't feel the need to keep on paying. That was three months ago and I've heard nothing since, and have recently joined a gym which is cheaper, with no contract, and to be honest I much prefer it to TF as the emphasis is not being skinny, the instructors are friendly and down to earth and the classes are more varied. Hopefully that will be the end of it now! Those who were helpful, thanks a lot, however the people who responded with aggression (pointless as my post was not offensive in any way), I would rather you just ignored my posts in future.

    I conversed with them over the phone and they officially cancelled the contract for me there and then; meaning from here on I have no ties with Total Fitness.
    Oh, and they did send me a letter explaining I owed them money but when I phoned them and told them my particular gym increased the monthly payments without warning / asking customers, they apologised and told me my debt was written off.

    What's a "!!!"...
