No, an employee can only be expected to travel in their own time to the full time place of work and can only be expected to do the same if the temporary place of work is within a certain travel radius from the full time place. All travel times above this has to be paid for in addition to normal working hours but can be paid at normal time rate as opposed to overtime rate, the exception to this being travel to and from a course where accomodation is paid for by the employer. I say this from an employers point of view.
Do you have a cite for that. AFAIK its a matter of contract/custom & practice rather than employment law.0 -

Probably not, that refers to the working time directive, if you look at the overtime link from that page:
"There's no legal right to pay for working extra hours, and there are no minimum statutory levels of overtime pay, although your average pay rate must not fall below the National Minimum Wage"
So you might fall foul of NMW if it happens frequently0 -

I was hoping that the definition of "work" might help, albeit that link is in respect of the working time regulations.0 -
I suspect it boils down to the line between them paying as little as possible and you telling them to stuff their job & claimimg constructive dismissal.
The tribunals view would probably be coloured by how often it happens & whether you get paid overtime normally or expected to work untill the jobs finished0 -
Personally, that is what I think is happening. It is a London based company, that bought out another company in Leeds and they are systematically getting rid of departments and staff for one reason or another.
They have already made some people redundant. I think this is just another underhand way of basically getting people to quit their jobs.
I believed it was the basis for constructive dismal, because this just looks like one thing in a line of what is to come.
The thing is though the person it is happening to doesn't want to lose the job, but at the end of the day I can only see something else cropping up for them.0 -

It could be constructive dismissal but bear in mind that if they are changing their contract for business reasons and the judge deems these reasons to be valid that any payouts will be lower....if they are doing it for just the hell of it then obv the payouts are higherThe Googlewhacker referance is to Dave Gorman and not to my opinion of the search engine!
