Help please, Advice needed

Hi all,

I`m new to the forums here,

Around two weeks ago i ordered some new doors for my home from a local company online, I paid online with my card and thought that was it sorted and my new doors would be delivered shortly as i needed them quickly, I emailed the company twice with no reply whatsoever and a week ago i phoned the company to see what had happened to my order and they told me the doors were out of stock, They haven`t took the payment for these doors out of my account yet although they have my card details, What are my rights as a consumer? Was this company in the wrong selling me items that were out of stock? How long should i wait before contacting the company again? Do you think i should contact trading standards?

Thanks for reading and any help much appreciated,

Gary.

They haven't charged your card, therefore they haven't sold you anything...

Thanks for your reply, I do have an order confirmation, So do you suggest cancelling my order with this company and purchasing elsewhere?

Agreed with xocbc you haven't bought anything. If you feel they are taking too long then you have two options:
    1) Call them and inform them that you wish to cancel your order. Go and order elsewhere or if ordering different doors from the same people call them first to see if they're in stock before you even start to go through their payment procedure

2)(This is the cheeky one) You have no legal right to this but if you call them up and politely inform them that you are not happy with the level of service they have provided and unless they rectify the situation immediately either by dispatch of the goods or some sort of goodwill gesture (be it a discount or not paying P&P or getting them to throw in some nice handles [if they also sell those] or whatever) then you'll be cancelling your order and will not provide them with any future business. If whoever answers the phone seems unhelpful ask to speak to a manager or supervisor. The worst that can happen is they say no and you cancel your order as per "1)" all you've lost is a few minutes of your time.

Although their service is poor there's not really a need for TS unless they refuse to cancel or something else. I would watch the credit card monthly statements in case they charge but provided it's over £100 spend then you can claim it back from the card company under "section 75" (see here if unfamiliar)

    Good luck

    Gary,
Posts crossed because mine was quite a long 'un. Hope I answered your question. It depends how long you want to wait and how confident you are trying to push them for something more =)
