council tax rebate

If the local authority has decided to prosecute for the claim then suelees1 is spot on. The money will be reclaimed via your Council Tax Bill however the local authority can still prosecute. Ive seen a few similar cases recently where people are re-paying but have still been prosecuted and found guilty.
If the Council Tax payments are not made then you are potentially looking at bankruptcy or commital to prison for non-payment so you need to ensure that the payments are made as and when requested.
As dmg24 has already said, the fact you are re-paying shows only that the money is owed, the court case will decide if there was any criminal actions involved.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
