£80 fine for over staying in service station

Hi folks

Bit of advice needed if possible, I was tired and needed a rest after driving for a good few hours. I stopped at Birch Services on 21/05/10 at 14:33 and left at 17:35 because I was there longer than 2 hours I have been charged £80 (£50 if I pay by the end of 04/05/10) only got the notice today.

Is this enforceable? I have also had a £20 admin charge from Jaguar contract hire for the job of forwarding the fine :mad:

If I do not pay the £80 they will then charge me an extra £40 admin charge plus I imagin the cost of Jags admin to forward the letter bringing the total bit to £160. How can they get away with such charges?

    Unenforceable. Ignore it. :D Also tell jaguar to bin any further correspondence and not bill you for forwarding it.

    Well as a private motorist you could safely ignore the notices/letters. But as you've found out, Jaguar are going to charge you admin costs so I guess you would be better off paying it.

    Not sure you can ignore it as there are clear signs saying 2 hours max unless you pay and display. IF they take it to court I would have thought they would win.

    You should also write a formal letter to Jaguar. Inform them this is not a fine and you are therefore not liable for any charges they levy against you.

    Spoke to Jag and it is their policy to forward any letters of fines releating to the vehicle along with a £20 admin fee. Best stump up or the Jag admin fees will end up costing me more than the value of the fine :mad:

    Harsh way to learn a lesson but in future I will be very careful when parking up for a nap.

    Doesn't work like that. Read Martin's guide to PPCs.

    IF they take you to court, well they wont take you to court.

    Please see Parking tickets section, this is an invoice not a fine.

    Write a letter to Jaguar stating that this is an invoice and not a fine and that that you are not liable for any costs.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.

    Its not a fine. Tell them this. All it is is a speculative invoice. Only councils and the police can issue lawful fines. Read the stickies in the parking fines sub board.

  • Read the terms and conditions of whatever contract you have signed with Jaguar. They will mention Fines and Penalties, ie police or council tickets. This is just a speculative invoice from chancers. Point out to Jaguar that under your contract you are not liable for their "admin" charges in this case and will not be paying them.
    Some vehicle hire companies are already wise to this and ignore PPC invoices, it seems Jaguar either don't know or they do and see it as a money making opportunity.
