Faulty Bike

Afternoon all MSEer's.

I am in need of some advice/help. To cut a long story short, my mountain bike got stolen. Insurance company arranged for another of similar value to be delivered to me from Evans cycles (a well established bike shop).

I received the bike early April, within a month the crank (pedal arm) started to wobble so I took the bike to my nearest Evans shop which is 35mile round trip. They did a free service on it as it was 1st service ever. Went to collect 2 days later and crank (pedal arm) was still wobbling so I told member of staff. They took the bike into the back and tighten it.

Week later happens again. Took it back to shop. They said they are not familiar with this model in the shop. They tightened it again, reset the chain/gears and increased the pressure on the crank along with something that should tighten the tread (lock tight or something) 3 days later happens again.

I have emailed head office complaining saying that I am not happy and ideally I want a different bike. They email me back;
"Unfortunately the bike is outside the 28 day return policy and has been ridden, if you have had work carried out by another bike shop then you will need to speak to them about the work they carried out etc.

If you have any other questions please don't hesitate to contact us "

Obviously completely ignored my email! Do any of you good people have any ideas? Please?

    Who assembled the bike ? Crank arms need tightening on assembly / set up of the bike and if you did it yourself it should be in the instructions provided.

    Thanks for your reply. The bike came already assembled, all I had to do was put on the actual pedals and tighten the handlebars.

    The tread on the crank arm may have damaged due to this fault.

    im guessing the cranks have worked loose and increased the hole on the arms
    so now they will always work loose
    what model bike is it? any link to the specs?

    its a no name chainset,so im going to guess its a taper fit
    an older design,now superceded by splined drive
    Im betting the movement in the crank arm has opened up the drive hole in the chainset
    so now there will be movement in the chainset and it will work itself loose
    Week later happens again. Took it back to shop. They said they are not familiar with this model in the shop

    I dont get this? The reason i asked for the model is i wondered if you had quite a high end bike with new componentry
    however you have a basic a to B bike.
    theres nothing on that bike that should throw any bike mechanic

    Thanks for your reply, I now it is a basic bike and this problem has managed to throw "qualified mechanics" on 2 separate occasions. I am now locked in a battle with the insurance company and the bike shop.

    At the moment I am left bike-less! The battle continues.
