Bank refusing to pay out on PPI for loan

Hi guys

My partner was made redundant from a 12 month fixed term contract around 8 months ago and put in a claim to be covered by her PPI with Lloyds and the loan that she got from them.

She was made redundant in the 11 month of the 12 month fixed term contract.

They refused to honour it by stating that she hadnt been made redudant. When we requested more info on the desision they told us that the reason that they hadnt paid is that my partners ex employer had stated that although she had been made offically redundant, they could not state that her contract would have been extended.

Now we are at the opinion that although her contract was coming to an end she was offically made redundant, receiving letters to that effect, receiving a redundancy package of one months pay and all the help that the employer put in to place for the other 44 redundant employees.

We contacted Lloyds about this and suggested if thay didnt sort it out we would take them to the small claims court and/or make a complaint to the financial odbudsman.

I have two questions with regards to this matter.

Can we take them to the small claims court for the payments they should have made during this period, its around 7 months?

or should we complain to the financial odbudsman or do both?

    So sorry to hear this and I personally think there is a good case here, why don't you give LLoyds another try first, even if they have given the final decision, they are still known to change it in your favour.

    You could do this by email and copy it on to the Chief Exective officer (CEO) and tell them how disappointed you are with the outcome, the policy is obviously worthless and your out of pocket due to this, and of course as I do mention to most who have reclaims against LLoyds, the FSA are punishing banks for not investigating complaints properly.

    You can take to small claims court to what I know of, but the amount I believe must be under a certain amount to reclaim, I have never dealt with the courts on mine but I am sure some on here will know how it works.

    I have always used the Financial ombudsman service (FOS), it may take some time with these, due to the high volumes of complaints they are dealing with, but it is a completely free service.

    Going back to Lloyds, they are one of the most difficult of banks to deal with, especially when it comes to complaints.

    With a few of mine, although they did at first give offers of goodwill, I would not accept them, wrote back and told them I was not happy and I WAS mis sold, despite their findings, and did not believe they investigated properly.

    You could also do this, because it seems that LLoyds fobs off with the same excuses to everyone, and you could mention "despite their findings, you do not feel the complaint was investigated properly, and am disappointed they have not upheld due to genuine reasons to reclaim on the policy", then tell them its worthless, they will not pay out, which is a total waste of time paying for the policy, and deprived of your money.

    Then mention the policy certainly wasn't sold in your best interest.

    You could do this by giving them 7 days to get back to you, and if you hear nothing by then, tell them you will forward your complaint to the FOS, which if successful they would then be eligible to pay out further charges, this can be avoided if they reconsidered the complaint in your favour, you could also tell them if this does go as far as the FOS, you will also be requesting for further redress for the distress and the inconvenience this have caused.

    Ask they confirm the email is received, and when you should expect to hear, you can do this by email or letter by attachment.
