    Mr Herron said to comply with guidelines issued by the Department for Transport, bays had to be outlined with a single white line.
    However, the bays in North Silver Street, one of the roads where Ms Williams frequently parked, have a double white line at each end.
    Mr Herron said this meant the bays were unlawful and any tickets issued would – technically – be void.
    “You can’t break the law to enforce the law,” said the Sunderland-based campaigner.
    “The council must comply with the law. If they haven’t, the tickets aren’t worth the paper they are written on.”
    However, the council is standing by its decision to take Ms Williams to court, highlighting a special authorisation granted by the Scottish Government in 2008 permitting the continued use of the North Silver Street bays, even though the current markings are out of date.
    A government spokesman said: “Scottish ministers have devolved powers under the Road Traffic Regulation Act 1984 to authorise non-prescribed traffic signs and road markings

    Not really a twist- signs are authorised by Scottish Ministers based on recommendations by Transport Scotland. They are very much so more easy going than the DfT in England to be fair hence why the comments about London not getting them in the article are interesting. It is far easier to get authorisation in Scotland and hence the number of different signs in Scotland that you don't see in England. Scottish Courts are different- private clamping being illegal (edit not illegal that is silly, but viewed by courts as extortion!) in Scotland for example.

    I'm right up for having arguments on technicalities including on this board, when I supported someone who make a turn against a sign which was dubious but people stated was 'clear enough'. A few fines I can handle but getting so many thousands of pounds of fines and ignoring things I can't help but feel she deserves it in this instance for stupidity! :o

    The obvious problem as I see it is that by using this special authorisation in Aberdeen they have as a consequence shown all other bays marked in this way but outside Aberdeen to be outwith the regulations. Plus it is an admission that before the authorisation was granted the bays in Aberdeen were outwith the regulations.
    They cannot have their cake and eat it.
    The net effect could be very large indeed.
