Ebay - New Phone

Hi there
i recently bought a mobile on eBay as brand new in box, which it was. However i get no reception on the mobile, this can't be the network as my nokia get full reception.
Anyway i would like a refund not and exchange or repair - is this possible? through the dispute system??
other thing is the return policy on the listing
Feel free to contact me within 12mnts as I get 12mnts warranty from my supplier - I can deal with this for you. The accessories are not covered such as the charger, cable and batteries but only cheap to replace so not to worry if they do fail. Sorry, no returns for refunds as the phones are brand new and only sell new phones. Gladly accept returns for repair/replacement - just send it back to me and I'll deal with the rest.
My question is am i entitled to get my money back?

last week, it got delivery on Friday, plus i used buy it now. so looking at the website it says about the distance buying however with his terms i'm not sure what will apply.0

He's clearly a business and the item is faulty so he has to offer you a refund if you request one within 7 days (it can actually be more like 3 months for faulty items dependant on several criteria being met).
He can't claim you have no right to return on account of using the phone becuse it is faulty.
you have a right to cancel the sale, that means request a refund, under the distance selling regs.
I'd remind him of this fact......."A wise man once told me don't argue with fools because people from a distance can't tell who is who"........0 -

Is this an iphone by any chance?
Iphones that are blocked by the network will show as working, but with with no signal. They are generally phones reported lost/stolen.0 -
hi thanks for the advise, its not an i-phone.
i just want to return the phone and get my money back however getting a return address is proving very difficult. i go on holiday for 2 weeks on sunday and need this resolved.
