Sweatband.com - who do I go to?

I purchased a York cross trainer from Sweatband.com. It arrived today and after 2 hours we managed to construct it! Unfortunately, it doesnt work! There is no "resistence" when the pedals are rotated.
I had an email from sweatband when we ordered the machine telling us that if there are any problems then we will need to contact York direct.
Is this correct?
I have emailed sweatband this evening and also looked at some reviews and sadly there are not only complaints about sweatband's after sales service but also York's cross trainers.

I don't think it is correct no, I think under the Sale Of Goods Act 1998 your rights are all against the retailler, not the manufacturer. Tell you what though, I had a retailler do this to me recently and I got fab free advice (even a draft letter) from consumer direct- link here."I, on the other hand, am a fully rounded human being with a degree from the university of life, a diploma from the school of hard knocks, and three gold stars from the kindergarten of getting the sh*t kicked out of me." ~ Capt. Thank you for your reply.
I have spoken to Sweatband and they gave me the number for York who I am now dealing with. Just seems a bit odd. I would rather have a new unit rather than repair one that didnt work in the first place!0 -
Your contact with the retailer not the manufacture. But it might be worth a quick ring to YORK too see if its a common fault that can be fixed at home0

Thank you steve.
Yes I have spoken to York and they are sending out an engineer.
They seemed very efficient and quickly took my details and problem and informed me an engineer would be in touch. The problem is, both my husband and I work full time and over 20 miles away! So I cant see an engineer being able to fit a visit around our normal working day. :mad:0 -
Personally I would have returned the cross trainer to sweatband for a refund. You still have the option to do this if you are not happy with the repair option. Your claim is against the retailer not the manufacturer and who wants an item of exercise equipment that needs repairing on day one?
If you do decide to let them repair it I would recommend trying the cross trainer in the presence of the engineer once it is fixed as it may well be the drive belt that has come off. Sadly York cross trainers seem to be prone to this fault and it is likely to happen again soon after being replaced.
I speak from experience. I bought one from Amazon and had exactly the same problem except mine worked for about 2 minutes then the drive belt came off and could be heard flapping around. I just returned it for a refund and added my own review to all the others who had suffered the same problem.
There is a warning on them if I remember correctly not to replace the drive belt yourself otherwise you will invalidate the warranty, so it might be an idea to ask the engineer what he has done to prevent it happening again.0
