Philips UK - Ble Ray player problem

Hi. Wonder if someone on the board can help me with this quandry please?

I bought a Philips blu ray player from an online retailer in March. Shortly setting it up and playing a couple of discs in it, I was taken ill and didn't have the chance to play a further disc in it until last week. I've now realised that there is a software problem with it and have made contact with the retailer and also with Philips. Thje retailer have tried their best to help but as it is more than 28 days since it was delivered, they advise I deal with Philips. Philips want me to send it to their repair centre in Manchester for them to take a look at it. I have told then that the original box etc has been disposed with. They have responded, advising i wrap it in some brown paper and they will collect it with DHL! I'm certainly not happy to wrap it like that, nor have DHL handle it as I've seen how they throw things around sometimes. I also told Philips that they don't deliver their products wrapped in brown paper so why should they advise me that this would be sufficient! I have also told tem that they shouldn't sell players in the first place if they are already providing software updates for it! Isn't this selling goods 'not fit for purpose'? I forunately paid by credit card for this item and it cost more than £100 but would really like to keep it as part of my system and it's features are great (if they worked!)

    If you are not happy wrapping it in brown paper, why not wrap it in bubblewrap and put it in a box?

    Any not fit for purpose claim would be against the retailer as part of a claim under the sales of goods act, but due to the timescale since purchase, they would be obliged to offer a repair/replacement/refund (technically their choice), which is what Phillips are offering anyway.

    Software updates are available for all manner of things e.g. phones, PCs, so a perfectly normal thing to happen. Not one I would try and get at the company about.

    Can you upgrade the software yourself, and would this cause the problem, whatever it is, to be resolved?

    Wrap it in bubble wrap it should be fine if you use several layers and then put it in a box (supermarket) and label

    You can update via firmware Philips player I done this several times with dvd players. Check Philips web site usually burn img onto a dvdr/rw and then insert assuming it can be updated that way

    Your contract is with the retailer and not with the manufacturer. It doesn't matter if it's been 6 months since you purchased it, you have a contractual relationship with them and not Phillips.

    Get back on to them and give them hell the lazy, SOGA-dodging scoundrels. Let them deal with Phillips.

    Name and shame, because that is appalling advice from them.

    For the first 6 months it is up to them to prove there was not an inherant fault and after 6 months it is up to you. Given it was only 4 months ago I would ask nicely for a replacement (but they are within their rights to offer a repair).
    Thinking critically since 1996....
