25th March 2010 - Taken my head out of the sand at last
I've been popping up on different threads, especially Niddy's. Thought I'd tell everyone what had happened and where I am up to incase it helps anyone.
From when my marriage split up I was left with debts I could not pay and had been making token gestures of £1 a month to the loans/credit cards I had. Most have now fallen off my credit files with only the biggie remaining - unfortunately this has been checked and is at the present enforceable but I still can't repay it so trying to blag it with help.
Money wise I had been doing just about ok, had completed financial statement which was why my debts got just £1 a month. In 2005 I took seriously ill, rushed into hospital and stayed there for two months. No-one could access my accounts or deal with my financial affairs and so began the spiral of charges. Tried to reclaim in 2007 but was caught up in the test case. Now trying again after being advised by the NATWEST manager I have a strong case. Fingers crossed.

*** Complaint now sent to FOS FOS replied and are looking into everything for me, have contacted organisations and already refused an offer they had been made by Capital One (I didn't know an offer had been made)

Took along time to get my head around to doing everything, but when it came to nearly breaking my relationship I had no choice but to attack things head on. Not worth losing everything over money.
Hopefully we can get that back on track now that we both know the words from the hymn sheet.
Niddy, you have been fabulous, even though he was abit jealous of you lol.
He was involved in a car accident last year, now, if we could just get that to pay out enough to clear the two credit cards we could almost be laughing.......RainbowLiberty0 -

Ahhh but rainbow, that's cos you were on here learning stuff and like you said to me at the time, he could log in and see everything - typical bloke, we all get protective/jealous - bless - its in our blood!

Regards car accident, hope this gets sorted - but it can take years, Mrs Niddy is still waiting for conclusion after 2 years.... it does drag on a bit especially if you reject the derisory first offer! :eek:2010 - year of the troll

PMSL well I guess not but it was near the beginning of me starting everything, I was still very much a newbie and didn't want to get anything wrong.

It would get dealt with alot sooner if he could make up his mind which company to use and who is the most ruthless. He was hit in the rear by an Articulated lorry, whilst about to turn left.
Does anybody know of a good accident claims company as this is out of my comfort zone of consumer rights
Everything just a waiting game, IF we get the charges back we can repay overdrafts and then start on repaying the credit cards, or IF he gets paid out on the accident we can repay the credit cards and then start working on the overdrafts.
Luckily things weren't as drastic as I had orginally thought and we shouldn't have to sell the house to clear the mess up as I'd first thought.RainbowLiberty0 -

well PM the Mrs and she'll tell you a good one, she had one for the first year and a half - they were awful, we are going to sue them later for wasting time etc and misleading - what a joke.
The bigger companies are not always the best! There are restrictions though as to the amounts, may mean going for more Physio....

Have you stopped payments or are you still sending them a £1 monthly?
Also have you got much hassle over the phone from the companies if you have stopped?0 -
Niddy told me to stop all payments, I was even paying a gym membership 11p a month (Robbers All The Way ;-))
I actually messed up when I initially CCA'd everyone as I sent my full address, phone number, email address and actually signed the letter myself. I've learnt alot since being on here though.
Did look into changing my number and email address but to be fair as yet I haven't been getting any phone calls - except from First Direct wanting me to repay the overdrafts I have with them. Going to have to sort out some kind of repayment plan with them until I hear back from the FOS as I'd hate to be nearly clear on my credit file (June 2011) for them to go and default me and cause the clock to start ticking again. Not sure if it would but don't want to risk it for the sake of giving them the £5 I used to pay the other debts. Hopefully I will get some of the bank charges back and that will wipe out all the overdrafts. FINGERS CROSSEDRainbowLiberty0 -

Yep - Niddy did indeed "suggest" you cease payments, however regards to 1st Direct, if you're wanting to avoid damaging your credit file, then you ought to come to some arrangement quick smart - I did explain that failure to pay can result in a Default, however if you have overdrafts (as they are exempt from CCA) i'd suggest you maintain payments into the account, to at least look at reducing the balance.
Thing is you don't want to get loads of late payment markers, either - do you?2010 - year of the troll
