Hi i called them a few weeks ago never had to ask for help before when they took my details they even said 'How have you coped' Thomas sleeps around 2 hours a night and has done for years as i said its what i have been used to but its affecting mine and my daughters relationship as well as i am too tired to do anything with her, they said i will hear from them soon that was 2 weeks ago:AAutism isn't the end of the world just a journey to another one:A0 -
I agree that what you did was wrong but you have admitted it and are paying back what you owe so why should we be now taking you to court surely it would be better using there time and money investigating people that are still defrading us now. Keep us informed and if they take you to court II think people on MSE should write to the PM and complain0

Have you been interviewed under caution? If not, then they can't take you to court as you have not had your rights adhered to. How much was the overpayment altogether? They would normally offer you an admin penalty which is 1/3 of the overpayment on top of the overpayment as a fine if you accept you did wrong - but that is if the overpayment is relatively small. If it is over (it used to be) £1500 then it would automatically be considered for court proceedings. In my experience as an ex fraud investigator, the courts usually awarded a conditional discharge and no costs! Depends on the amount of overpayment mind you - if we are talking £thousands, then it would be more serious, but if it is quite small then it is unlikely to be much of a punishment, especially as you are already paying it back. They would also adjourn for pre-sentencing reports and as you have a disabled son, I very much doubt you will be going anywhere!!! Don't fret.0

If a person commits burglary, confesses to the crime and offers to return the possessions they stole, do they avoid prosecution? No.
Benefit fraud is a criminal offence. Admission of the offence and paying back what was taken is neither here nor there, other than this will go in the defendant's favour during sentencing.
A lot of fraudulent claimants would continue the fraud had they not been caught out. If all it took was a confession and an offer to repay the money to avoid further penalty via prosecution, a hell of a lot more people would be doing it, and in my opinion there are too many people doing it already.

Ring up who sent the letter and ask them what it means they will advise you . I know it may be difficult but better than hearing it for first time in court.xx0

We may all have done things that we regret but I doubt that everyone has engaged in a criminal activity!0
