I suppose it is all down to descriptions and what you were told/thought you were buying. If this was in the spec sheet of the car you bought then I would argue my case.
There is no issue with refund (if agreed) with regard to the scrappage scheme - MIL bought a faulty new car from VW in March - and got a full refund on Friday (including scrappage allowance0Total Quidco earnings - £547.98

Just to add, I once bought a vehicle and they changed the paint colour slightly and I hated it. I did not take delivery.0

Back to the original Q - you knew about the SS feature being standard from Jan2010 so did you ask to make sure yours would have this?
Also, did you order the car brand new and pick colours, or did they have one "in stock, unregistered" ie in a field somewhere off the M1. Which could've been an 09 model.
Find your chassis number and ring Fiat HQ a ring to get them to confirm the build date.
Thanks for the reply. I ordered it to spec as it has quite a few optional extras on it. I have a quote listing the start/stop as a standard feature when i ordered it in March. I rang Fiat the other day who confirmed it should be a standard feature from Jan 1st. I was concerned that the car is a 2009 model that has been shipped out as a 2010 car. I dont want any retrofit. I want my money back as it was not what I ordered. I will ring fiat as you advised to get the build date.0 -

I am intrigued as to why you accepted delivery then?
Could you confirm why stop/start is such an important feature. Its widely ridiculed and imo will actually in the long term detract rather than add to the value once all the negative effects start to kick in and be publicised (i.e increased wear and tear and fuel consumption).0 -

I accepted delivery as all the optional extras were in place. The glass roof, the alloys, stripe etc were all there. I thought the stop/start was an inbuilt feature like on a friends Yaris.
The point is, Fiat raised the price of the 500 in the new year to compensate for the stop/start moving from an optional feature to a standard feature. This was on top of VAT going back to 17.5%. My point is, I paid for that feature and the car does not have it. I don't want a retrofit. It also highlights that the car was not built to order as I was promised due to the amount of extras I put on it.
So can anyone tell me that I can refuse the car as it was not what was ordered. If so, what would be the best way of going about it? I feel like writing them a letter refusing the car, dropping it off with them and hiring a car which I will bill to them.

I'd imagine you do have the right to refuse it because it's not as described but it'd be a long drawn out process - if they offered a retrofit with a courtesy car whilst this was being done why would you turn this down? It'll only cause you stress and legal costs fighting them :-\0

I doubt they would do it as a retrofit.
If its on the paperwork and you have paid for it then it should be there.
The failure here is on the the pre delivery inspection which should have picked it up befroe you ever saw the car.
In case like this you can get your money back but its far cheaper for the garage and manufacturer (depending where the !!!! up lies) to try and induce you to keep the car by offering lots of incentives such as additional warranty, free servicing, etc.
