advice sought please

hi looking for some advice folks,

for 6 years ive owned an ex council house which my mother and myself bought from local authority in scotland, joint names on mortage but ive paid full amount apart from less than £20 benefits agency for my mother whom is on old age pension.

Now, my mother is now wanting to move out of house and hence is wanting me to the sell property, question is: my mother wishes to rent a home, would she be liable for housing benefit at all? as she wishes all benefits from house sale to go to myself and family.

  • no if the house is sold and she doesnt take what is rightfully hers it will be seen as deprivation of capital,after all why should the house be sold but the TP pay her benefits?

    do you live in the house as well?

    is she in receipt of Guarantee part of pension credits?

    if she isn't and she 'gives away' her capital it will be counted as if she still has it
  • thanks for that, a -no i no longer reside in the property having left home 3 years ago when i gotmarried and b- i think she receives the guarantee part of the pension credit.

    f you sell up and you keep all the profit any LA who is doing their job properly will see this as deprivation of capital and assume that she has a half share in the profits.

    They would also inform the Pension Service of the circumstances behind the house sale so it could/would have repercussions for her on-going entitlement to Guarantee Credit.

    She could be left with no Guarantee Credit and with no money/help to pay for the privately rented accommodation.

    If she wants to move, why can't she buy somewhere with the proceeds of the sale of the current property?

    Does mums pension credit award say she has an Assessed Income Period for a number of years or perhaps forever?

    Why can;t she use the proceeds from the sale of the house to pay her own rent rather than expecting the tax payer to pick up her tab?
