neighbour's car was stolen and then damaged mine!

not too badly but the back bumper is dented and paintwork damaged by scraping etc. Just wondered if I should ask the neighbour to put in a claim on his insurance for my car or will i have to sort it myself. do feel sorry for him as his is much more damaged but if he's already claiming for his then he'd lose his NCD anyway. Thanks for any advice.

    You will need to make your own claim over this - either off your own insurance (where you will have to pay your excess and reclaim it off your neighbour) or direct from your neighbour/neighbour's insurance (no excess for you to pay).

    got the feeling it might come under unisured driver as the policy holder (your neighbours) was not driving the car ?

    If the driver is identified, then the owner's insurer will cover the damage caused (RTA insurer). But if the driver is unknown, then it's either a claim off a comprehensive policy or use the untraced driver scheme at the MIB.

    12. What is the position if injury or damage is caused by a stolen vehicle?

    Section 151(2) of the Road Traffic Act 1988 places an obligation on the insurers of the legal owner of a stolen vehicle to meet a judgment against the driver of the stolen vehicle.

    That is when the driver (ie. thief) has been identified.

    As previously posted, the MIB can be used if the driver is untraced.

    MIB can't be used if the OP has fully comp - its an insurer of last resort and with fully comp you can claim on your own policy. Been there, got the T shirt.

    neighbour has just been round to see if I've done anything about getting my car repaired - which I haven''t as yet - it's not too bad just superficial. He's third party only so isn't claiming off his insurance and I don't want him to lose his NCD because of me as his car is not really worth repairing because of damage and age of car. so I'm just going to do a DIYjob or maybe see if someone can do a cheapish job of just "polishing out" the marks. i think my OH thinks I'm a mug - but my way of looking at it is my car is still driveable - his isn't - and it's not his fault.

    I dont think you would be able to claim off of his insurance anyway, as the thief has not been caught (see posts above)
