Mobile phone bought from cashgenerators.com

Hi, I bought a Nokia X6 mobile phone from Cash Generators. I ordered it online on the 23rd of May. The site claimed that it was a brand new 16GB edition on the 3UK network.
I received the phone the following Tuesday, found that it was in an unopened Nokia box that still had the Nokia seal on it. I opened it up to find that everything was there, it was a working phone and everything was great. Up until the moment that I rang 3UK up to request an unlock code so that I could use the phone on o2.
I was told that I could not receive an unlock code because the phone was registered as part of a contract and that they couldn't unlock it and I was told that I shouldn't have it, even though I bought it.
I researched before I purchased and found out that I could get an unlock code for the phone. Cash generators did not state anywhere on the page that it was a contact phone and this has caused me to be £240 out of pocket.
Once I found out that it was a contract phone, I rang up the store that I bought it from. And was told that they could not offer me a refund because their website said it was a 3UK phone. Now, on their website they say they offer full refunds upto 7 days. Were they just saying this to stop me from getting a refund. I received the phone on Tuesday.
Would I be able to get a full refund by ringing their head office up on Tuesday as they are closed now and it's a bank holiday on Monday?

You have a right to return an item for any reason under the DSRs, but you must give notice within 7 working days from receipt.
The item would technically be 'as described' (unless you specifically asked them if it could be unlocked), so that wouldn't apply. Thanks for the reply, I found out today that the phone had been blocked as it was reported as being stolen by the person who sold it. I rand the shop up and was told they could do nothing but I eventually go through to the area manager and offered to give me a full refund so I didn't get the police or trading standards involved.
So problem solved and lesson learnt. Never use cash generator. :rotfl:0
