I assume I have no rights now?

I brought a Buffalo LS-500GL from Ebuyer 3 years ago, well 2 of them. About a year or so ago I'd walk past them and notice them moaning because the fans had stopped spinning. Being an IT Engineer by trade I just shut them down, blew on them and they started up again. Would work fine for ages then stop spinning. Anyway. They are also set to e-mail me every day so I can see if there are any errors (lucky I set that as the first one arrived with a messed up HDD and e-mailed me to tell me so).

Anyway. Noticed one of them hadn't e-mailed in days but was still on. Thought was OK till I tried to access it. Couldn't. Turns out it had died. No warning though. Fan will not spin. Check HDD after taking it out and that's fine. But the fan on the unit won't spin and think this is why the unit won't work now.

Do Ebuyer have to repair this now, even though its out of warranty? Under the Sales Of Good Act 1979 aren't they responsible for up to 6 years from sale?

Or is that only if this was a inherent fault?

    If "they are also set to e-mail me every day so I can see if there are any errors", then surely you did have a warning that something was wrong when you "Noticed one of them hadn't e-mailed in days but was still on".

    Anyway, are you a business user?
    Consumer legislation may not be applicable if you are.

    Nope not a business user.

    Nope because they regularly don't e-mail ever since I got them. Bug in their e-mail system, even if on and working fine.

    SOGA is not simply "consumer legislation".

    Under SOGA An item doesnt nessary have to last 6 years as long it can be shown to fail though fair ware and tear. I wouldn't say 6 years is unreasonable for a NAS system. What your problem is now that it been more than 6 months, It down to you to prove that fault is inherent to the item and not though fair ware and tare. Ie you need to get a independent engineer at your cost that you can recoup if it finds in your favor. They have basically have the choice(I know it more complicated than that) of refund, repair or replace But they only have to give a refund of 50% the original total you paid and if you've lost any data unfortunately they got no obligation to recover it for you.

    I've recovered the data myself booting the drive off USB into Linux. It's just the unit now needs repairing.
