    Hi guys,

Need some advice..I place an application for a payday loan on the 20th of this month and all the relevant information was received contract signed blah blah blah and everything was ok upto the point of not receiving the money after three days of waiting(£120 in total - £150 payback).

I have called and emailed the company(payday express) but they have been completely unresponsive.

Fortunetly I called my bank on the 24th who confirmed that and I quote 'no direct debit or monies have been placed into your account from this company', the bank have since placed a watch on my account and cancelled my current credit card and ordered a new replacement.

Recently I have found out that(through a call from my bank) asking me if I wish to verify allowing the removal of my funds for this repayment, obviously I have said no and the bank have been happy to comply.

Obviously any help from you all would be gratefully received as I'm at my wits end as I will not be bullied into paying for monies I have not received.

I've used their services twice before without any problem....

i cant really understand your post tbh, it reads to me that you didnt get the money from them but are worried about them taking it back:wall:

    QUOTE]
Up to there your posting was quite good pull the other one.

    Ok sorry folks,

I know it's taken a little time to answer, now that I've confused everyone reading this post I'll simplify it for you:

Loan application made on the for sum of £120 and the electronic signature was made on the 17th June 2010 no monies as confirmed by the bank ever arrived after four days.

I emailed the collections department to inform them, they finally returned my email on the 21th informing me of the debt repayment being payable on the 28th June.

I called my bank and they informed me that as said previously 'no direct debit or monies have been placed into your account from this company'.

My bank has since cancelled the card, but they continue to attempt to recover the debt via my bank account.

My bank put a stop on the company taking money from my account and are watching for them as they seem intent on removing my funds from me as a personal thought if the mistake was on their part and not mine does that invalidate their claim?

And what part of the Consumer Credit Agreement 2006 would I be able to use for such a purpose?

    Hope this helps?

yeah but there trying to quote section 86e of the credit consumer act upon me now
  • new information as it was received...

Extra added info from recent email...

Please note on the 17th of June a copy of the signed loan agreement was forwarded to this email address, please refer to this. We also request documentation from your bank that confirms that they accept that the transactions on your bank account were carried out without your knowledge fraudulently.

As it would stand no information was asked from payday express (checked with bank)
